1. Agreement to Terms
Welcome to Sturdy Construction Services Inc. These Terms of Service ("Terms") govern your use of our website and the construction, renovation, and related services we provide. By accessing our website or engaging our services, you agree to be bound by these Terms.
Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, please do not use our website or services.
2. Our Services
Sturdy Construction Services Inc. provides residential and commercial construction and renovation services in Calgary and surrounding areas, including but not limited to:
- House flips and complete home reconstructions
- Kitchen renovations, bathroom remodels, and basement renovations
- Garage suites and room additions
- Commercial buildouts including restaurants, daycares, medical clinics, and retail spaces
- Permit acquisition, code compliance, and city approval assistance
3. Quotes and Estimates
All quotes and estimates provided by Sturdy Construction Services Inc. are subject to the following conditions:
- Validity: Quotes are valid for thirty (30) days from the date of issue unless otherwise specified
- Accuracy: Estimates are based on information provided and visible conditions at the time of assessment. Hidden conditions discovered during work may result in additional costs
- Free Estimates: Initial consultations and estimates are provided at no charge
- Scope Changes: Any changes to the project scope after quote acceptance may affect the final price and timeline
4. Payment Terms
Payment terms are outlined in individual project contracts. General terms include:
- Deposit: A deposit may be required upon contract signing to secure your project date and order materials
- Progress Payments: Larger projects may require milestone payments at specified stages of completion
- Final Payment: The remaining balance is due upon project completion and your final approval
- Accepted Methods: We accept payment via e-Transfer, cheque, or other methods as agreed upon
- Late Payments: Late payments may be subject to interest charges as permitted by Alberta law
5. Project Timeline and Delays
We strive to complete all projects within the estimated timeframe. However, please note:
- Estimated Timelines: Project timelines are estimates and may vary based on project complexity, weather, permit approvals, and material availability
- Force Majeure: We are not liable for delays caused by circumstances beyond our control, including natural disasters, government actions, supply chain disruptions, or pandemic-related restrictions
- Client Delays: Delays caused by client decisions, approvals, or changes may extend the project timeline
- Communication: We will promptly notify you of any anticipated delays and work to minimize their impact
6. Client Responsibilities
To ensure successful project completion, clients agree to:
- Provide accurate and complete information about the property and project requirements
- Ensure safe and reasonable access to the work site during scheduled work hours
- Make timely decisions on materials, finishes, and design choices
- Obtain any necessary approvals from homeowner associations, landlords, or co-owners
- Secure personal belongings and remove items from work areas as requested
- Comply with payment schedules as outlined in the contract
7. Changes and Modifications
Changes to the agreed-upon scope of work are handled through change orders:
- All changes must be documented in writing and approved by both parties
- Change orders will include revised pricing and any impact on the project timeline
- Additional work will not commence until the change order is signed
- Minor adjustments may be accommodated without formal change orders at our discretion
8. Warranties and Guarantees
Sturdy Construction Services Inc. stands behind our work:
- Workmanship Warranty: We provide a one (1) year warranty on workmanship from the date of project completion
- Manufacturer Warranties: Materials and products are covered by their respective manufacturer warranties, which we will assist you in processing if needed
- Exclusions: Warranties do not cover damage caused by misuse, negligence, unauthorized modifications, or normal wear and tear
- Warranty Claims: Please contact us promptly if you discover any workmanship issues during the warranty period
9. Limitation of Liability
To the maximum extent permitted by Alberta law:
- Our total liability for any claims arising from our services shall not exceed the total amount paid for the specific project
- We are not liable for indirect, incidental, consequential, or punitive damages
- We are not responsible for pre-existing conditions, structural issues, or defects not caused by our work
- Clients are responsible for obtaining appropriate insurance coverage for their property
10. Insurance and Licensing
Sturdy Construction Services Inc. is fully licensed and insured. We maintain comprehensive general liability insurance and workers' compensation coverage as required by Alberta regulations. Proof of insurance is available upon request.
11. Cancellation and Termination
Either party may terminate the agreement under the following conditions:
- Client Cancellation: Clients may cancel before work begins with written notice. Deposits may be non-refundable to cover administrative costs and materials ordered
- Work in Progress: If cancelled after work has begun, payment is required for all work completed and materials purchased
- Our Right to Terminate: We reserve the right to terminate for non-payment, unsafe conditions, or breach of these Terms
12. Dispute Resolution
In the event of a dispute, both parties agree to:
- Good Faith Negotiation: First attempt to resolve the matter through direct communication and negotiation
- Mediation: If direct negotiation fails, submit the dispute to mediation in Calgary, Alberta
- Arbitration: If mediation is unsuccessful, the dispute shall be resolved through binding arbitration in Calgary, Alberta
- Costs: Each party shall bear their own costs for dispute resolution proceedings
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any legal proceedings shall be conducted in the courts of Calgary, Alberta.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective when posted on our website with an updated "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
